Donald Trump's Framework of Consequences and Incentives

Donald Trump's voracious urge for payback has rapidly morphed into a structured apparatus. Over the year since his election, the chief executive's fury and impulses have adopted the guise of government actions similar to reminiscent to historical repressive systems. Justice department officials who do not cooperate are immediately removed and replaced by devotees. Political figures who confront him risk indictment, judicial process and penalties. Opponents have been designated under presidential memoranda as “anti-American”, “anti-Christian” and “against free markets”, and menaced with legal action as “terrorists”.

Government Institutions Transformed

Every case involving legal action of political opponents and immunity for supporters displays its own particular features. Yet, notwithstanding their individual nature, they embody expressions of what has developed as a deliberate method. Such events are far from random. Trump's removal of federal prosecutors and law enforcement personnel, coupled with his installation of supporters in key positions, started rapidly, soon assumed a consistency, and has now been formed into a structure. DoJ and the Federal Bureau have been restructured into ideological organizations under Trump's direct orders to carry out his wishes. Wrongdoing has been turned into normal. This is the system of punishment.

Administration is preoccupied with punishing the chief's alleged adversaries than they are with protecting our public welfare.

Inside the Apparatus

The beginnings of this mechanism has been revealed in the legal complaint of several previous top Federal Bureau agents submitted in September in the US district court in DC against top official an administration figure and justice department head a key figure for illegal termination in “a effort of retribution against Plaintiffs for what Defendants judged to be a refusal to show proper political loyalty”. In the complaint that one official, the previous temporary head, details a discussion in which he “openly admitted the impropriety of his actions”.

The official had sought to shield agency personnel from being terminated, the complaint claims. Patel advised him that “administration officials” – interpreted by Driscoll to be the presidential administration and federal prosecutors – had directed him to dismiss anyone who they identified as having been involved in a law enforcement case against the president. The complaint continues: “Patel explained that he had to fire the individuals his superiors told him to dismiss, because his capacity to retain his own job depended on the removal of the personnel who handled investigations involving the President. The director commented that there was no option he or Driscoll could do to prevent these or any other dismissals, because ‘the bureau sought to place the leader in detention and he hasn't forgotten it.’” When he advised him he was disregarding the bureau's own policies, he allegedly said “he knew that and he realized the character of the summary firings were likely unlawful”.

Extensive Consequences

Since his claimed acknowledgment to the official, the Department of Justice and the law enforcement agency have been dismantled and redirected for his retribution system. Several of the FBI's high-ranking agents were dismissed or pushed out in the first days of the administration. About 4,500 legal professionals at DoJ have taken a “deferred resignation program”. At least several DoJ lawyers, including those in the Manhattan division, resigned in objection over what they considered as ideological pressure in withdrawing the corruption case against the local official, the mayor, in return for his collaboration with his ICE detentions of immigrants. The public integrity section of the justice department, which manages ethical violations, has been cut down to minimal staff. The equality section has been severely reduced: 70% of its employees has resigned. 33% of senior leaders at DoJ have quit. The unit upholding environmental law has lost a majority its management.

Rewards and Sanctions

In the Adams case, the acting US attorney for the southern district of New York, she, resigned in objection against what she labeled as the “trade-off”. A key figure, the president's “enforcement chief,” appeared as the agent with Adams on a media outlet to state: “Should he fail to deliver, I'll reappear in New York City.”. Meanwhile, Emil Bove, formerly the acting deputy attorney general and a past legal representative, who arranged the deal, was awarded an appellate federal judgeship, a possible pathway to the supreme court.

Trump's immunity for crimes committed while in power, provided by the extraordinary judgment of the Republican majority on the supreme court, thus preventing his criminal case over the political violence and maintaining his electoral prospects for the 2024 election, is the foundation stone on which he relies to shield his stalwarts. Given this protection, he has been freed to authorize misconduct. The consequence of the supreme court decision infuses his administration and the GOP completely. The court matter has escalated. In the words of the former president's legal adviser the figure remarked about the Watergate
